The Kitchens, Inc., doing business as Forkable (The Kitchens), operates its website, located at forkable.com ("Website"), provides software and services, and facilitates ordering and delivery of food from third party restaurants through a network of independent food delivery couriers (the Website software and services is collectively "Forkable"). Your privacy is important to The Kitchens and this Privacy Policy lays out The Kitchens' policies and procedures surrounding the collection and handling of such information. This Privacy Policy applies only to websites under control of The Kitchens. It does not apply to any Food Preparation Partners' sites, other third party services linked to Forkable or offline activities related to The Kitchens Inc.'s services. Please review this Privacy Policy with the Terms of Use, as many terms within this Privacy Policy are defined by the Terms of Use.

1. Information The Kitchens Collects

The Kitchens may collect the following personal information from users of Forkable: (1) first name, (2) last name, (3) current street address, (4) billing address, (5) delivery addresses, (6) phone number, (7) e-mail address (8) credit card information, (9) bank account information, (10) driver's license info and (11) tax compliance information. Collectively we call this "Personally Identifiable Information" or "PII").

In addition, The Kitchens may collect information regarding past Forkable orders, favorite Food Preparation Partners, food preferences and dietary restrictions, customer service inquiries and which company(ies) or organization(s) you are affiliated and/or employed with.

The Kitchens also uses web analytics software to track and analyze traffic on Forkable in connection with The Kitchens' advertising and promotion of Forkable services. The Kitchens may publish these statistics or share them with third parties without including PII.

2. The Kitchens' Use Of Collected Information

The Kitchens uses PII to create customers' Forkable accounts, to communicate with customers about Forkable services, to offer customers additional services, promotions and special offers and to charge for purchases made through Forkable. The Kitchens uses stored PII to facilitate orders, to customize future order processing for users, to facilitate payment, to screen Food Preparation Partners and Delivery Providers, and for tax compliance purposes. Note that, for enhanced security, The Kitchens does not store full credit card information on its own servers, but instead relies on specialized partners to store the full data, while only storing metadata on The Kitchens'servers. You may request that The Kitchens cease storing certain PII at any time, but you might not be able to take advantage of certain features of Forkable or Forkable in its entirety. The Kitchens may also use PII to enforce the Forkable Terms of Use.

For Food Preparation Partners, additional information may be requested and stored regarding your business. Additional information may be, but is not limited to: types of food served, pricing, and contact information of certain employees or your affiliates. Similarly, we may collect additional relevant information from Delivery Providers.

The Kitchens may use cookies and other persistent memory browser features to remember users of Forkable and to enhance users' experience on the Website. For example, when users with Forkable accounts return to Forkable, such features may be used to identify those users and allow Forkable to provide certain user-specific information such as Forkable account information, past orders and favorite Food Preparation Partners.

The Kitchens shares selected PII to third-party vendors and service providers who work in connection with Forkable including information to Delivery Providers (in particular location and contact information for the purpose of coordinating the delivery.) In addition, The Kitchens shares Forkable customers' order content, special order instructions, first and last name, location and telephone number with parters when orders are placed to the extent it is necessary to process those orders. Forkable may also forward names and emails to partners when addressing customer feedback. The Kitchens may also disclose information about users to third-parties where The Kitchens has a good faith belief that such disclosure is necessary in order to: (i) protect, enforce, or defend the legal rights, privacy, safety, or property of The Kitchens, its affiliates or employees, agents and contractors (including enforcement of any agreements, including Terms of Use); (ii) protect the safety, privacy, and security of users of the The Kitchens employees, owners, or members of the public; (iii) protect against fraud or for risk management purposes; (iv) comply with the law or legal process; or (v) respond to requests from public and government authorities.

3. The Kitchens' Protection of PII

The Kitchens, Inc. uses reasonable security measures to protect PII from unauthorized access, destruction, use, modification and disclosure. The Kitchens takes a tiered approach to security, such that more sensitive information, like bank account numbers, is especially carefully guarded. Unfortunately, even with these measures, The Kitchens cannot guarantee the security of PII. By using Forkable, you acknowledge and agree that The Kitchens makes no such guarantee, and that you use Forkable at your own risk.

4. Your California Privacy Rights

The Kitchens welcomes residents of the State of California to use Forkable and complies with the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA). This section describes your rights under California law and how to exercise them.

4.1 Categories of Personal Information We Collect

In the preceding 12 months, we have collected the following categories of personal information:

  • Identifiers: Name, address, email, phone number, account name
  • Financial Information: Credit card number, bank account information
  • Commercial Information: Order history, food preferences, dietary restrictions, favorite restaurants
  • Internet/Network Activity: Browsing history on our Website, device information, cookies
  • Geolocation Data: Delivery addresses and, when you permit, precise location for delivery tracking
  • Professional Information: Employer or organization affiliation (for corporate meal programs)

4.2 Sensitive Personal Information

We may collect the following categories of sensitive personal information:

  • Account login credentials (username and password)
  • Precise geolocation (only when you enable location services for delivery tracking)
  • Financial account numbers used for payment processing

We use sensitive personal information only as necessary to provide Forkable services, process payments, and fulfill deliveries. We do not use or disclose sensitive personal information for purposes other than those permitted under CPRA.

4.3 Sources of Personal Information

We collect personal information from: (1) directly from you when you create an account, place orders, or contact us; (2) automatically through cookies and similar technologies when you use our Website; and (3) from third parties such as social media platforms (if you choose to connect your account) and our restaurant and delivery partners.

4.4 Sale and Sharing of Personal Information

We do not sell your personal information for monetary consideration. We may share certain information (such as device identifiers and browsing activity) with advertising partners for cross-context behavioral advertising. You have the right to opt out of this sharing.

4.5 Your Rights Under California Law

As a California resident, you have the following rights:

  • Right to Know: You may request information about the categories and specific pieces of personal information we have collected, the sources of that information, our purposes for collecting it, and the categories of third parties with whom we share it.
  • Right to Delete: You may request that we delete personal information we have collected from you, subject to certain exceptions.
  • Right to Correct: You may request that we correct inaccurate personal information we maintain about you.
  • Right to Opt-Out of Sale/Sharing: You may opt out of the sale or sharing of your personal information for cross-context behavioral advertising.
  • Right to Limit Use of Sensitive Personal Information: You may limit our use of your sensitive personal information to only what is necessary to provide the services you request.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.

4.6 How to Exercise Your Rights

To submit a request to know, delete, or correct your personal information, or to limit the use of your sensitive personal information, you may:

We will respond to verifiable consumer requests within 45 days. If we need more time (up to an additional 45 days), we will inform you in writing. To verify your identity, we may ask you to confirm information associated with your account. You may designate an authorized agent to make a request on your behalf by providing written authorization.

4.7 Opt-Out Preference Signals

We honor Global Privacy Control (GPC) and similar browser-based opt-out preference signals as valid requests to opt out of the sale or sharing of your personal information.

4.8 Data Retention

We retain your personal information for as long as reasonably necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements, and to protect against fraud or safety concerns. Retention periods vary based on the type of information and our ongoing business needs:

  • Account information: retained for the duration of your account and as needed thereafter for legal compliance, fraud prevention, safety purposes, and service improvement
  • Order and transaction history: retained as needed for tax compliance, dispute resolution, and service improvement
  • Payment information: retained by our payment processors in accordance with PCI-DSS requirements
  • Marketing preferences: retained until you unsubscribe or request deletion

When personal information is no longer needed for these purposes, we will delete or anonymize it in accordance with our data retention policies.

5. Children's Online Privacy Protection Act

Forkable is directed to adults, over the age of 18. The Kitchens does not knowingly collect information from children under 13 years of age or have any reasonable grounds for believing that persons under the age of 13 are accessing the Website or making use of Forkable. If The Kitchens discovers any inadvertently collected personal information of a person under the age of 13, that information will be swiftly deleted from its records. If you believe that The Kitchens may have any information from a person under age 13, please contact The Kitchens at team@forkable.com.

6. Privacy Policy Amendments

The Kitchens reserves the right to make changes to this Privacy Policy at any time. If The Kitchens changes this Privacy Policy, an updated version of this Privacy Policy will be posted on the Website. Changes will not apply retroactively and changes addressing new functions for a service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms, you should discontinue your use of Forkable. Your continued use of Forkable after any such changes constitutes your acceptance of the new Privacy Policy. You should also check back from time to time to ensure you are aware of any changes.
